Underground Ice provides seasonal flavors, drop products, merchandise, and related services. By using our site or services, you confirm that you are at least 16 years old or have permission from a guardian.
We reserve the right to update or modify these Terms at any time. Continued use of our services means you accept any changes.
2. Drop Culture & Limited Releases
Underground Ice operates on a drop-based system.
Drop items are:
Limited in quantity
Not guaranteed to restock
Sold on a first-come, first-served basis
Once a drop sells out, it may not return. Underground Ice is not responsible for missed releases or sold-out products.
3. Orders & Payment
By placing an order, you agree that:
All information entered is accurate
You authorize Underground Ice to charge your selected payment method
Prices and availability may change without notice
We reserve the right to cancel or refuse any order for reasons including suspected fraud, incorrect pricing, or violation of these Terms.
4. Pickup & Drop Locations
Pickup times and locations may vary depending on drop schedules.
Underground Ice is not liable for:
Delays caused by weather
Traffic or travel conditions
Missed pickups due to customer error
If you miss your pickup window, we cannot guarantee product replacement or refund due to the perishable nature of our items.
5. Refund Policy
Because our products are small-batch and perishable, all sales are final.
Refunds may only be considered if:
You received the wrong item
The order was not properly fulfilled
There was a confirmed mistake on our part
Refund requests must be made within 24 hours of receiving your order.
6. Allergens & Food Safety
Our products are made in facilities that may process:

Other potential allergens
Customers are responsible for reviewing ingredient information before ordering. Underground Ice is not responsible for adverse reactions related to allergies or sensitivities.
7. Subscriptions
If you enroll in an Underground Ice subscription:
Billing occurs on a recurring schedule
You may cancel anytime before the next billing date
Missed pickups or deliveries due to customer error are non-refundable
Subscription prices and availability may change with notice.
8. Community Commitments
Underground Ice supports local schools, recovery programs, and community initiatives. Contributions, givebacks, or donations are not guaranteed and may vary by season, drop, or location.
9. Customer Conduct
We aim to create a positive, safe, and respectful environment. We reserve the right to deny service to anyone engaging in abusive, harmful, or inappropriate behavior.
10. Intellectual Property
All logos, images, branding, flavor names, and content are the property of Underground Ice and may not be copied, altered, or used without written permission.
11. Limitation of Liability
Underground Ice is not liable for:
Losses related to delays or cancellations
Damage caused by third-party delivery services
Issues outside our control (weather, shipping, outages, etc.)
Use of our services is at your own discretion and risk.
